These Terms of Use govern your use of Scraperscapes.com and Scraperscapes.ca, operated by Scraperscapes Inc., an Ontario corporation.
By accessing or using this website, you agree to these Terms of Use. If you do not agree with them, please discontinue use of the website.

1. Website Content

The Scraperscapes website is provided for informational purposes and to introduce the artwork, collections, commissions and related activities of Scraperscapes Inc.

We endeavour to ensure that information presented on the website is accurate but cannot guarantee that all information will at all times be complete, current or error-free.

Artwork availability, dimensions, materials, presentation and pricing may change without notice.

2. Artwork and Enquiries

Submission of an enquiry through this website does not constitute an order or create a contract for purchase.

When you enquire about an existing Scraperscape, we will provide applicable information concerning availability, size, material, presentation, pricing and delivery.

A purchase is confirmed only after the relevant details have been agreed upon and Scraperscapes Inc. has accepted the order.

3. Commissioned Works

Commissioned Scraperscapes are individually developed in consultation with the client.

The scope, imagery, dimensions, materials, price, payment arrangements, production schedule and other applicable terms will be agreed upon before work proceeds.

Because commissioned works are created specifically for an individual client, commissioned or customized works are final sale except where otherwise agreed or where the work arrives damaged, subject to any rights provided by applicable law.

4. Pricing and Payment

Prices may vary according to the artwork, size, material, presentation, commission requirements and other factors.

Applicable taxes, shipping, insurance or other charges will be identified before a purchase is confirmed where applicable.
Payment terms will be provided as part of the individual purchase or commission arrangement.

5. Production, Shipping and Delivery

Many Scraperscapes are produced to order. Estimated production and delivery times are provided in good faith but may vary because of production schedules, materials, shipping conditions, destination or circumstances beyond our reasonable control.

Shipping charges are determined according to the artwork and destination and will be communicated before an order is confirmed.

Scraperscapes Inc. is not responsible for delays caused by carriers, customs authorities or circumstances beyond our reasonable control.

6. Returns

If you wish to return an eligible non-commissioned work, you must contact Scraperscapes Inc. within seven (7) days of receiving the artwork.

Returned artwork must be in its original condition and packaging. Return shipping costs are the responsibility of the purchaser unless otherwise agreed or required by law.

All returns require prior authorization. Once a return has been approved, Scraperscapes Inc. will provide a Return Merchandise Authorization (RMA), the appropriate return address and shipping instructions.

Artwork should not be returned without prior authorization.

Commissioned or customized works are final sale except where otherwise agreed, where they arrive damaged, or where applicable law provides otherwise.

7. Artwork Damaged in Transit

If an artwork arrives damaged, please contact Scraperscapes Inc. promptly.
We may request photographs of the artwork, shipping container and packaging to assist in assessing the damage and processing any applicable carrier or insurance claim.

Please retain all original packaging until the matter has been resolved.
Where appropriate, Scraperscapes Inc. will work with the purchaser to arrange a replacement, repair, refund or other reasonable resolution.

8. Copyright and Intellectual Property

Unless otherwise stated, all artwork, photographs, images, designs, text, logos and other original material appearing on this website are owned by or used under authority of Scraperscapes Inc. and are protected by applicable copyright, trademark and other intellectual-property laws.

Purchasing an artwork does not transfer copyright or reproduction rights in that artwork.

No Scraperscapes artwork or website image may be reproduced, copied, published, distributed, modified, commercially exploited, used to create derivative works or otherwise used without prior written permission, except as permitted by law.

9. Personal and Non-Commercial Use
Visitors may view the website and may retain limited extracts for personal, non-commercial reference.

Nothing on this website grants any licence to reproduce, sell, commercially exploit or otherwise use Scraperscapes artwork, photography, designs, trademarks or other intellectual property.

10. Third-Party Links

This website may contain links to third-party websites or services for convenience or informational purposes.

Scraperscapes Inc. does not control and is not responsible for the content, availability, security, policies or practices of third-party websites.

11. Website Availability

We endeavour to keep the website available and functioning properly but do not guarantee uninterrupted or error-free access.

Access may occasionally be interrupted for maintenance, technical problems, security reasons or circumstances beyond our reasonable control.

12. Disclaimer and Limitation of Liability

The website and its content are provided on an “as available” basis.

To the extent permitted by applicable law, Scraperscapes Inc. is not liable for indirect, incidental, special or consequential loss arising solely from the use of, or inability to use, this website.
